401k VAT contributions

I am owner of small construction company having 40+ Employees. We have safe Harbor 401k with 4% match which allows us 3 owners to fully contribute our 30k into 401k. I’m being told by our TPA that this Voluntary after tax contributions (VAT) are subject to discrimination testing and are counted as a regular match, safe harbor doesn’t help this test. Since most often only highly compensated employees make VAT contributions, they are rarely able to pass the testing. do you agree and is their a way around this testing?
